NATIONAL REDRESS MECHANISM FOR CHILDREN

Within the framework of its protective mandate, the National Human Rights Council (CNDH), in line with Law No. 76.15 on its reorganization, three mechanisms were established within the Council's structure: the National Preventive Mechanism against Torture (NPM), the National Mechanism for the Protection of the Rights of Persons with Disabilities and the National Redress Mechanism for Children.

The National Redress Mechanism for Children serves as an accessible avenue for children to report rights violations, ensuring inclusivity without distinction. This mechanism adheres to the guidelines of the United Nations Committee on the Rights of the Child (CRC), specifically outlined in General Comments No. 2 and 5.

The mechanism carries out the following tasks:

  • Receiving complaints from children, from individuals acting on their behalf, or from any other concerned parties;
  • Conducting investigations into received complaints, which involves studying, addressing and making decisions on each case;
  • Facilitating hearings and involving parties related to the violation or complaint;
  • Proactively addressing any identified violation of children's rights;
  • Notifying competent judicial authorities if it is determined that a child's rights have been significantly compromised.

The mechanism, comprised of elected members, was established following their election by CNDH’s General Assembly on September 21, 2019.

This mechanism, hosted by CNDH, is in charge of protecting children from rights violations. It is accessible and inclusive, ensuring compatibility with all groups of children without discrimination.

The mechanism operates in alignment with the guidelines set forth by the United Nations Committee on the Rights of the Child (CRC), particularly as outlined in General Comments 2 and 5.

The National Redress Mechanism for Children conducts the following missions:

  • Receiving complaints presented directly by children, their legal representatives or third parties;
  • Conducting investigations into received complaints, which involves studying, addressing and making decisions on each case;
  • Holding hearings inviting relevant parties associated with the violation or complaint;
  • Addressing any identified violation of children's rights that come to the mechanism’s attention;
  • Notifying competent judicial authorities if it is determined that a child's rights have been significantly compromised.

The National Redress Mechanism for Children can be accessed through CNDH or through its regional commissions.

The foundation of the mechanism’s Code of Ethics lies in:

  • Universal Declaration of Human Rights (1948)
  • Declaration of the Rights of the Child (1959)
  • Convention on the Rights of the Child (1989) and its Optional Protocols
  • Pertinent national laws concerning children’s rights

 

 

 

  • Equality and non-discrimination: The mechanism receives and interacts with children without distinction based on social affiliation, age, ethnicity, economic status, disability or other factors. Both girls and boys perspectives are considered without discrimination.

  • Children’s participation: 
    - The mechanism communicates with children in an appropriate, interactive manner. 
    - The participation of children is voluntary, devoid of any coercion or pressure, and with their explicit consent. 
    - The mechanism considers the family as a primary partner when working with the child. 
    - The mechanism also enhances coordination and cooperation with other authorities dedicated to protecting children's rights.

  • Children’s safety: The mechanism ensures suitable reception conditions for children, addressing financial, psychological and social aspects.

  • Confidentiality: The mechanism ensures the confidentiality of collected data, committing not to publish children's information.

  • Trust: The mechanism adopts a friendly approach, emphasizing listening responsiveness to instill trust and encourage children's active participation.

  • Respect: The mechanism treats all children with utmost respect, recognizing them as full-fledged individuals. Their opinions are respected and considered in the decision-making process.

  • Presenting outcomes to the children: The mechanism presents outcomes and conclusions to children using appropriate communication means.
